1. Acceptance of Terms
By accessing or using Forj Intel ("Service"), available at forj.cloud, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Forj Intel. By creating an account, subscribing to a plan, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Service
Forj Intel is a YouTube analytics and coaching platform that provides:
- Analytics dashboards and performance insights for YouTube channels
- Data-driven recommendations for content strategy and channel growth
- Expert coaching sessions with experienced YouTube growth strategists
- Tools and reports designed to help content creators understand and improve their channel performance
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.
3. User Accounts
To access certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorised use of your account
You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account and use the Service. Forj Intel reserves the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Google sign-in and YouTube API Services
The app at app.forj.cloud uses Google sign-in and YouTube API Services so you can connect your channel and see analytics. By signing in you grant Forj Intel read-only access to the Google and YouTube data described in our Privacy Policy. We do not post, edit, or delete content on your YouTube channel.
Use of the app also means you agree to YouTube's Terms of Service. Google describes its own data practices in the Google Privacy Policy. You can revoke Forj Intel's access at any time from your Google Account permissions.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Scrape, crawl, or use automated means to extract data from the Service without our written permission
- Attempt to gain unauthorised access to any part of the Service, other user accounts, or related systems and networks
- Interfere with or disrupt the integrity or performance of the Service
- Upload or transmit viruses, malware, or other malicious code
- Use the Service to harass, abuse, or harm other users
- Reverse-engineer, decompile, or disassemble any aspect of the Service
- Resell, sublicense, or redistribute access to the Service without our explicit consent
Violation of these terms may result in immediate suspension or termination of your account.
6. Intellectual Property
Our content: All content, features, and functionality of the Service -- including but not limited to text, graphics, logos, icons, software, analytics tools, coaching frameworks, and methodologies -- are owned by Forj Intel and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.
Your data: You retain full ownership of all data, content, and materials you provide to the Service, including your YouTube channel data and analytics. By using the Service, you grant Forj Intel a limited licence to access, process, and display your data solely for the purpose of providing the Service to you. We will never sell your data to third parties.
7. Coaching Services
Forj Intel offers expert coaching sessions as part of certain subscription tiers. You acknowledge and agree that:
- Coaching sessions are advisory in nature and intended to provide guidance, strategies, and recommendations
- Forj Intel and its coaches do not guarantee specific results, including but not limited to subscriber growth, revenue increases, or view counts
- Success depends on many factors beyond our control, including your content quality, consistency, niche, and market conditions
- Coaching recommendations are based on best practices and professional experience but should not be considered infallible
- You are solely responsible for decisions made regarding your channel and content
8. Payment Terms
The Service operates on a subscription-based pricing model. By subscribing, you agree to the following:
- Billing: Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan) and will automatically renew at the end of each billing cycle unless cancelled
- Pricing changes: We may update our pricing from time to time. Any changes will be communicated at least 30 days in advance and will apply to the next billing cycle
- Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access until that date
- Refunds: Payments are generally non-refundable. However, refund requests may be considered on a case-by-case basis at our discretion
- Free trials: If we offer a free trial, you may be required to provide payment information. If you do not cancel before the trial ends, your subscription will begin and you will be charged accordingly
9. Limitation of Liability
To the maximum extent permitted by applicable law, Forj Intel and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of the Service.
Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you have paid to Forj Intel in the twelve (12) months preceding the event giving rise to the claim.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Breach of these Terms
- Conduct that we determine, in our sole discretion, is harmful to other users or the Service
- Extended inactivity
- Failure to pay applicable fees
Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data before account deletion, where practicable.
11. Changes to These Terms
Forj Intel reserves the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, for material changes, notify you by email or through a notice within the Service.
Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
